Charges that Whole Foods Market Inc. cheated Texas consumers by overcharging for deli and other prepackaged items have been dismissed.

Judge Lee Yeakel of the U.S. District Court for the Western District of Texas rejected arguments filed by plaintiffs in Markman vs. Whole Foods Market Inc. et al, according to a Reuters story. The suit claimed that Whole Foods and several of its executives intentionally defrauded shareholders by routinely overpricing prepackaged products.

In earlier, similar, cases in California and New York, Whole Foods paid settlements of $800,000 and $500,000, respectively, in cases claiming the company overcharged for things like including the weight of the container in salad bar and hot bar purchases.
